Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ApplyWorld platform, websites, and services (collectively, the "Services") operated by StudyWorld Education Group ("ApplyWorld," "we," "us," or "our"). By registering as a partner or accessing the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility and Partner Accounts

To use the Services, you must be a registered education recruitment agency or authorised representative thereof. You must provide accurate, complete, and current registration information and keep it up to date. You are responsible for all activity that occurs under your account and must keep your login credentials confidential.

ApplyWorld reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or misrepresents student information.

2. Platform Licence

Subject to your compliance with these Terms, ApplyWorld grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for the purpose of submitting and tracking student applications to partner institutions.

• You may not sublicence, resell, or provide access to the platform to third parties.
• You may not reverse-engineer, copy, or create derivative works from any part of the Services.
• You may not use automated tools, scrapers, or bots to interact with the Services without prior written consent.

3. Partner Obligations

As an ApplyWorld partner you agree to:

• Submit only genuine, complete, and accurate student applications.
• Obtain all necessary consent from students before sharing their personal data with ApplyWorld.
• Comply with applicable laws in your jurisdiction, including data protection and consumer protection laws.
• Not engage in misrepresentation, fraudulent documentation, or any conduct that could harm a student or an institution.
• Promptly respond to requests from ApplyWorld for information or clarification regarding submitted applications.

4. Commissions and Payments

Commission rates, payment schedules, and eligible programmes are set out in your Partner Agreement and the Commission Schedule available in your Partner Dashboard. ApplyWorld reserves the right to amend commission terms with 30 days' written notice.

Commissions are only payable for applications that result in a confirmed enrolment and where the commission has been received from the relevant institution. ApplyWorld is not liable to pay commission on amounts not received from institutions.

5. Student Data and Privacy

You acknowledge that student personal data submitted through the platform is processed in accordance with our Privacy Policy. You must not share student data with any party other than as required to facilitate the application process, and must comply with all applicable data protection legislation including Nepal's Individual Privacy Act 2018 and any other relevant laws.

6. Intellectual Property

All content, trademarks, logos, software, and materials on the platform are the property of ApplyWorld or its licensors. Nothing in these Terms transfers any intellectual property rights to you. You may not use the ApplyWorld name, logo, or branding without prior written approval.

7. Prohibited Conduct

You must not:

• Use the Services for any unlawful purpose or in violation of any regulation.
• Submit false, misleading, or incomplete student documents.
• Attempt to gain unauthorised access to any part of the Services or another partner's account.
• Interfere with or disrupt the integrity or performance of the Services.
• Engage in any conduct that disparages or harms ApplyWorld's reputation.

8. Suspension and Termination

ApplyWorld may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including Sections 5, 6, 9, and 10.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. ApplyWorld does not warrant that the Services will be uninterrupted, error-free, or free of viruses. We do not guarantee admission outcomes for any student application submitted through the platform.

10. Limitation of Liability

To the maximum extent permitted by applicable law, ApplyWorld shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services, even if advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the total commissions paid to you in the three months preceding the event giving rise to the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform at least 14 days before the changes take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
